Taka Privacy Policy

Thank you for using the TAKA™ mobile software application (the “Mobile App”) you have downloaded from the Apple App Store, Google Play or elsewhere. The Mobile App is the property of Synkt Games, Inc. (“Synkt Games™,” “we” or “us”). 

TAKA Mobile App Privacy Policy (“Privacy Policy”) covers our treatment of Personal Information (as defined herein below) and other information that we collect when you: (a) access or use the Mobile App; (b) become a TAKA Member (as defined in the TAKA Website Terms and Conditions (“Terms and Conditions”)); (c) use the TAKA Services (as defined in the Terms and Conditions); and/or (d) register for one of our sweepstakes, promotional offers or contests (the “Sweepstakes”). It is important that visitors are fully informed about the use of their Personal Information.

When you register on our Mobile App, you hereby agree and acknowledge that your Personal Information will be placed into the Synkt Games database and that such Personal Information shall be shared with third parties for marketing purposes.



In order to use the Services, you are required to create an account.

There is no cost to create an account, but you will be asked to provide a mobile phone number or email address, a password and a username. Please note that your username will be available to other TAKA Members throughout your TAKA experiences.

By registering with, or providing Personal Information on, the Mobile App, users allow us and our affiliates to make their Personal Information available to third parties in accordance with the terms of this Privacy Policy, and to otherwise provide marketing offers to such users. While on the Mobile App, submitting an application to become a TAKA Member, registering for a Sweepstakes or otherwise utilizing the TAKA Services, we may collect “Personal Information” from you. For the purposes of this Privacy Policy, Personal Information shall mean individually identifiable information from or about an individual including, but not limited to, the individual’s: (a) full name; (b) e-mail address; (c) billing address; (d) daytime, evening and/or cellular telephone numbers; (e) credit card information; (f) at the individual’s option, his/her PayStack® account information; (g) date of birth; and/or (h) any other information requested on the applicable form. For purposes of this Privacy Policy, items (e) and (f) in the preceding sentence shall be referred to as “Sensitive Information.”

Synkt Games may also use technology, such as cookies (as described below), transparent gifs, frames, server log analysis and other technologies as they are developed, to enhance your experience on the Mobile App.



Synkt Games respects the privacy of children of all ages. Synkt Games particularly recognizes the sensitivity of personal information concerning children under the age of 13 and therefore provides this special notice to parents and guardians regarding the collection and use of information collected from children in this age group.

This Mobile App is not directed towards young children. Synkt Games is intent on complying with applicable laws and regulations regarding children. Specifically, Synkt Games will not knowingly collect and maintain any personally identifiable information from children under 13. Parents are hereby put on notice that as a result of the foregoing, Synkt Games does not currently provide a mechanism to obtain parental consent.

If you are a parent or guardian who has discovered that your child has submitted his or her personal information, Synkt Games will make reasonable efforts to delete the information from its database, at your request.

To request the deletion of your child's information, please send an email to support@TAKA.com and be sure to include in your message the email address and username that your child submitted.



As part of the registration process to create a TAKA account or to participate in Sweepstakes, you may be asked to provide certain information that does not personally identify you. For example, you may be asked to provide information concerning your entertainment preferences, purchasing habits, and the like. Synkt Games requests this information in order to enhance your online experience by understanding you better and to also make you aware of new services, programs or offers which may be of interest to you.

In general, you can browse the Mobile App while remaining anonymous. However, in many cases, if you wish to interact on the Mobile App, Synkt Games will collect certain non-personally identifiable information about your use of the Services. For example, Synkt Games might collect information concerning the type of Internet browser or computer operating system you are using, the domain name of your Internet service provider, your "click path" through the TAKA Mobile App, the website or advertisement from which you linked to the TAKA Mobile App, and/or the website that you go to when leaving the TAKA Mobile App. In order to do this, Synkt Games may use several technologies and perform system checks when a user visits the Mobile App. Examples of such technologies are cookies (as described below), transparent gifs, frames, server log analysis, and other technologies as they are developed. All technologies implemented on the Mobile App are used to enhance the user experience.

As discussed above, in general, Synkt Games uses information to improve and enhance your experience. However, from time to time, Synkt Games may share this information with other entities in an aggregate, non-personally identifiable form to show general demographic and preference information among users of the TAKA Mobile App.



Cookies: The first time that a user provides an e-mail address in connection with his/her activities at the Mobile App, we assign an identification number to that e-mail address and deploy a cookie to the applicable user's mobile device. Whenever that user comes back to the Mobile App using the same mobile device, the cookie allows the Mobile App to identify the user and to recall the user’s e-mail address. If, at any time, a user provides other information in connection with his/her activities on the Mobile App (such as name, address, birth date, gender, etc.), we may store that information, along with the user's e-mail address, in our user database. We may use the information stored in our database: (a) to effectuate the purpose or transaction for which the information was originally provided by a user; (b) to pre-populate information fields in the event that the subject user wishes to purchase products and/or services or sign up for and/or subscribe to services, promotions or other offers in the future; (c) to ensure that a user will not be repeatedly exposed to the same advertisements, offers and/or promotions while visiting the Mobile App; and/or (d) to, in connection with regular communication with a user, include offers, promotions or advertisements that were historically, or are likely to be, of interest to that user. We also use cookies to anonymously track and target the interests of our users to further enhance the experience on the Mobile App.

Action Tags: An action tag or a web-beacon (also known as a clear gif or a pixel tag) is a method used to track responses or actions by visitors who view certain advertisements or other information on the Mobile App. Action tags are 1x1 pixel images embedded in a website page that are used to transparently collect information. We may use action tags to count the number of times that visitors click on a particular banner ad or visit the pages of the Mobile App and to provide information about what products/services are viewed or purchased. We reserve the right to retain cookie and action tag data indefinitely. At no time will we share cookie-related, action-tag-related and/or generated information and/or data with third parties.



Each time that you visit the Mobile App, our web server automatically recognizes your IP address and the page from which you came. Your IP address is used to help identify you and to gather broad demographic information about you. We also use your IP address to help diagnose problems with our servers, to administer the Mobile App and to better serve you in using the products, services and other features associated with the Mobile App.



The Personal Information that you submit to us remains your property, but by submitting such information to us you grant us the right, subject to applicable state and federal law, to use the Personal Information (other than Sensitive Information) for marketing purposes. Without limiting the generality of the foregoing, we reserve the right to share, sell, rent, lease and/or otherwise distribute any and all Personal Information (other than Sensitive Information) with/to any third-party for any and all uses permitted by this Privacy Policy and applicable law. These third parties may include, but shall not be limited to: (a) providers of direct marketing services and applications, including lookup and reference, data enhancement, suppression and validation; (b) e-mail marketers; (c) telemarketers (where and to the extent permitted by applicable law); (d) SMS text-based marketers (where and to the extent permitted by applicable law); and (e) direct marketers.

We may also use your Personal Information for any purpose related to the Mobile App, Sweepstakes and/or TAKA Services, and/or marketing and survey purpose, on our own behalf and on behalf of our affiliates and subsidiaries. We may disclose Personal Information to third-party agents and independent contractors that help us create and/or operate promotions and surveys. You agree that we may contact you at any time with updates and/or any other information that we may deem appropriate for you to receive in connection with your continued use of the Mobile App, Sweepstakes and/or TAKA Services.

We are able to offer the Mobile App, Sweepstakes and TAKA Services to you, in part, based on your willingness to be reached by our third-party advertisers. Your Personal Information (other than Sensitive Information) will be shared with advertisers on an aggregate and non-aggregate basis. We also use contact information from your Personal Information to send you information about the Mobile App, Sweepstakes and TAKA Services, our other offerings and to keep you informed of our other products and services that may be of interest to you and to contact you about your billing account status. Please keep in mind, though, that we do not control, and are not responsible for, the practices of our third-party advertisers. If you wish to stop receiving future communications from us and/or third party advertisers, or if you wish to prevent the transfer and/or sale of your Personal Information to third parties (subject to restrictions contained in applicable state and federal law), please see the Removal of Your Information/Opting Out section below.

By submitting your Personal Information at the Mobile App, you agree to receive e-mail marketing from us and our third-party advertisers. In addition, where you submit a telephone number at the Mobile App, if ever, you agree that such act constitutes a purchase and we retain the right to contact you in accordance with the law.

In addition, where you submit a mobile telephone number at the Mobile App, if ever, you agree to receive mobile marketing including, but not limited to, SMS text-message based marketing, from us and our third party advertisers and marketers (where, and to the extent that, such marketing is permitted by applicable law). As such, we retain the right to contact you via SMS text-message based marketing in accordance with applicable state and federal law. Further, you agree that we reserve the right to share, sell, rent, lease and/or otherwise distribute your mobile telephone and other mobile data with/to any third-party for any and all non-marketing uses permitted by this Privacy Policy and applicable law.

We reserve the right to release current or past Personal Information: (i) in the event that we believe that the Mobile App, Sweepstakes and/or TAKA Services is/are being or has/have been used in violation of this Privacy Policy, the Terms and Conditions, any Contest Rules (as defined in the Terms and Conditions) or to commit unlawful acts; (ii) if the information is subpoenaed or otherwise requested pursuant to a valid legal proceeding; or (iii) if we are sold or acquired. Moreover, you hereby consent to the disclosure of any record or communication to any third-party when we, in our sole discretion, determine the disclosure to be appropriate including, without limitation, sharing your e-mail address.

If you enroll in certain TAKA Services or enter certain Sweepstakes, we may use your Personal Information to send you a welcome email that may confirm your user name and password. In addition, we may send you electronic newsletters, contact you about the Mobile App, Sweepstakes and/or TAKA Services and other products, services, information and news that may be of interest to you, and provide you with targeted feedback. In addition, if you identify yourself to us by sending us an email with questions or comments, we may use such information (including Personal Information) to respond to your questions or comments, and we may file your questions or comments for future reference.

We may also supplement the information that we collect with information from other sources to assist us in evaluating and improving the Mobile App and Services, and to determine your preferences so that we can tailor the Mobile App and Services to your needs.



If you give Synkt Games sensitive information (e.g., credit card numbers), Synkt Games will take all commercially reasonable steps to protect such information by establishing a secure connection with your mobile browser. Synkt Games employs a security technology known as a secure-socket-layer ("SSL") to protect the transmission of payment information to the Website. Unless otherwise specified herein or on the Mobile App, credit card numbers are used only for payment processing and are not retained for any other purposes.

While Synkt Games takes precautions against possible breaches in its databases, no website or internet transmission or connection is completely secure. Consequently, Synkt Games cannot guarantee that unauthorized access, hacking, data loss, or other breaches will never occur.

Synkt Games urges you to keep your personal information safe by memorizing your password or keeping it in a safe place, separate from your account information, as sharing your password with others may lead to unauthorized access to your information.



All postings on message boards, forums, chat rooms or other method of communication within the Mobile App will generally be available to, and freely accessible by, other users of the Mobile App as well as the general public. Therefore, users should not expect that any information they post will be kept private or confidential and are encouraged to exercise discretion when using the Mobile App. Additionally, your display name will always be included in conjunction with your postings on the Mobile App. Synkt Games is not responsible for events arising from the distribution of any information you choose to publicly post or share through the Mobile App.



The Mobile App may contain links to, or advertisements concerning other websites. Other websites may also reference, advertise, or link to the Mobile App. Synkt Games is not responsible for the privacy practices or the content of such other websites and expressly disclaims all liability associated with your use of, and the content on, such other websites and advertisements. You should check the applicable privacy policy of any website you may click through to.



By providing any personal information to the Mobile App, all users, including, without limitation, users in the member states of the European Union or Africa, fully understand and unambiguously consent to the collection and processing of such information in the United States of America.



As part of your use of the Mobile App, you are responsible for maintaining and updating, as applicable, your account information with current and complete information. You may edit and delete portions of your TAKA account information. To do this, please visit the "Profile" page to make changes or deletions.

W reserve the right to retain in our archival files any information removed from or changed in our databases. We may retain such information to resolve disputes, troubleshoot problems and/or enforce our Terms and Conditions. In addition, it may not be technologically possible to remove every record of the information you have previously provided us, as a copy may exist in a non-erasable form that will be difficult or impossible for us to locate.



By using the Mobile App, Sweepstakes and/or TAKA Services, you agree to the terms of our Privacy Policy. We reserve the right, at our discretion, to change, modify, add and/or remove portions of this Privacy Policy at any time. All Privacy Policy changes will take effect immediately upon their posting on the Mobile App. Please check this page periodically for changes. Your continued use of the Mobile App, Services and/or acceptance of our e-mail following the posting of changes to these terms will mean that you accept these changes and agree to continue receiving e-mail from us.
